Spurs knew of Primo misconduct since January, new lawsuit says


HOUSTON – A former psychologist who worked for the Spurs, Dr. Hillary Cauthen, has filed a lawsuit in Bexar County alleging the franchise “ignored her repeated reports of indecent exposure” by 19-year old guard Josh Primo in the hope that it could “ignore and then cover up his actions.”

“The Spurs organization was willing to sacrifice Dr. Cauthen to keep what they hoped would one day be a star player,” the lawsuit states. “Once Primo’s conduct entered the public sphere, the Spurs were forced to act and release Primo. The Spurs’ recent actions with regard to Primo are too little, too late.”

The cause of action suit was filed in Bexar County District Court on Thursday morning.

Cauthen’s lawyer, Tony Buzbee, said Cauthen made her first report about Primo’s conduct to Spurs management in Jan. 2022.

“Primo repeatedly exposed his genitals (nine times in total) to Dr. Cauthen during individual private sessions, despite her numerous complains about Primo’s improper sexual conduct to the organization’s leadership.”

Cauthen met with Spurs general manager Brian Wright again on March 21, 2022 to discuss Primo’s alleged conduct.

Buzbee said Cauthen wanted Gregg Popovich to know what was going on and said the Spurs told Cauthen in June that Popovich knew of the allegations. But Buzbee said he can’t be sure Popovich actually was told.

“The organization I worked for has failed me. … It took the Spurs 10 months to do the right thing. And that’s too long,” Cauthen said at the press conference.

Primo’s attorney William J. Briggs II said in a statement that his client is being “victimized by his former team appointed sports psychologist, who is playing to ugly stereotypes and racially charged fears for her own financial benefit.”

“In an act of betrayal against her young client, Dr. Cauthen, who is 40 years old, falsely claims Josh Primo exposed himself to her during the course of her numerous therapy sessions. Dr. Cauthen’s allegations are either a complete fabrication, a gross embellishment or utter fantasy.  Josh Primo never intentionally exposed himself to her or anyone else and was not even aware that his private parts were visible outside of his workout shorts,” the statement said. 

The statement also alleges that “Dr. Cauthen never informed her patient of the purported exposure.” 

In a move that stunned the NBA and ranks among the most shocking in franchise history, the Spurs waived Primo, 19, last Friday, just four games into his second season after the club selected him 12th overall in the 2021 NBA Draft.
